I need some help figuring out if I’m being discriminated against.

Here’s my story:

I go around a blind corner on a major highway in the rain. I am going under the speed limit. I then see a parked semi, with no lights on. No blinker, hazard lights, or break lights. I try to stop, but since the road was really wet, I couldn’t stop in time. My compact car collides with the back of a semi. Now, I actually manage to walk out of the car. Minor miracle. The trucker calls state police. The trooper shows up and talks to everybody but me, but that was understandable since I was going into shock. He calls an ambulance and I go to the hospital. The trooper even stops by the hospital to drop off some items I left at the scene, but I miss him because I’m in x-ray.

Now, the fun part. I get a copy of the preliminary report. I’m shocked to begin with, since the trooper never spoke to me. Then I realize that the woman who was right behind me, and saw that the semi lights were off, is not mentioned as a witness. Then I realize the report says I wasn’t injured. I was taken to the hospital, where I was treated for sprained joints and shock. And the trooper knew that. The trooper even gets the make of my car wrong.

Now, I’m trying to get things worked out. I get the run around when I try to get a hold of the trooper. So, I emailed the state patrol saying that I wanted to fix the report, because it isn’t fair. I get no response. So, I email asking who I file a complaint with, and the captain emails me back. He tries to smooth things over, but there is still no change. Now he’s sending me emails, calling me by my first name, treating me like a child. In fact, everyone is treating me like I just don’t know how the world works. I am not an idiot. I understand that there is a shortage of troopers in the state. But, if there is time to email me or call me and explain the crisis, why isn’t it used to talk to me about the accident? I’m beginning to think that maybe the police are watching out for one of their own, not for the good of the public.

yeah they will just try and make their jobs as easy as possible. It’s up to you to make it hard to not listen to you. Ask to speak to their superior, find out who it is yourself if possible as they may not give it to you directly. fill out a complaint thing and have it on record just in case it goes further.
write down everything that happened just in case it drags on then you’re not relying on your memory and it will be more correct.

Do you have any way of finding the woman who was behind you? If so, you would have a stronger case for any legal claims.

But I agree with James and Rushyo- if I were in your shoes, I would definitely talk to a lawyer– sometimes just a letter with her letterhead might do the trick. And see if there are any of those consumers rights reporters around. They often know how to call the next person up in the chain of command.

If you want to be more gradual about it, make copies of the report with the incorrect statements marked, make copies of any documents that show the the truth– hospital records, your car registration, photo of the scene, etc. Send the two with a polite but firm letter requesting to speak to a superior officer about the report. Give a date that you expect a response. If that does not work then take the two duplicate packets of all of those copies to your lawyer and reporter.

HELL YEAH… if you look into my posts about my children… you will see that they are or should i say… can be crooked.. and always look out for their own… i actually went to file papers on one officer.. the one officer in charge.. gave me the papers… told me how and where to fill out… and told me to sign here… and pointed… then she looked at me.. and told me that as soon as i signed my name.. she would arrest me for defermation of character… i was mistreated by this cop.. he refused to abide by my order of protection.. telling me that everything my ex abusive husband was doing.. were accidents… and long story short… life hasnt been the same since.. because of him… and because i was afraid to file those papers at that time… i havent done so as of yet…
