you file a claim against but get it in before their bankruptcy hearing or you’re SOL. you will only get a percentage of what you are owed.

So if you file a claim against them BEFORE their bankruptcy hearing, then you are ok?

you are entitled to SOME of your money… it’s up to the judge how much, depending on the company’s other financial obligations. i know a lot of people going through this sort of thing because of the recent airlines going under. good luck.

Unless you collect or file a claim with the bankruptcy court you will get nothing. If you file a claim, you still may get nothing. It’s up to the federal courts. If the company is deemed bankrupt they usually have no obligations to pay any debts.

They pay things based on priority. So paying their employees will probably come before your claim and other debts they owe. They might not have enough money to pay you back.
