If she signed away her rights, then she no longer has custody. The child will most likely stay with you all, or go into foster care.

depends on why she signed over the other child. I there was drugs or some capacity issue, the other child could be taken.. but you are correct, they usually try NOT to take a child from it’s mother unless necessary.

the 15 year old came home drunk and beat her mum then her mum and her boy friend hit the girl in the face all was arrested and she signed over rights. so in other words the 9 year old could b in danger????

I have seen instances where social services leave other kids in the home that they removed one from. in this case she signed over the 15 year old but not the 9 year old. if they find reason to remove the 9 year he will probably go into foster care unless the father has rights to him also and will fight to get him.

He can probably get custody of the daughter then since the mom has given her up unless criminal charges are pressed.

actual charges are assault, or child abuse / negligence / battery

Social services will do an investigation and If they find a reason to remove the boy from the home they will and more than likely custody would be given to the father if he has rights to the child if not he will have to get those rights reinstated through the courts.

it really all depends on WHY she signed her over to social services.. if the daughter was being neglected… and this is the reason why… then they will probably remove the son as well…
