I am currently in a Chapter 13 bankruptcy repayment plan.

I have been making payments in the plan for 1 year. I am planning to leave the United States and move to Australia. I am not sure what my options are in reference to my Chapter 13 because when I move I will not have the same income and be able to make payments. I want to start fresh but this burden just hangs over me and causes so much stress. I can not change my Chapter 13 to a Chapter 7 because I do not qualify for it now. Can the collection compaines go over seas to haunt me? What could I do? I have about $24,000 in debt….

Unlikley mate - Do a midnight flip. If you dissapear for 6 years they write the debt of anyway.

How much do you owe?

If you owe like 0 - 150/200k - unlikley they will be after you

any more than that then I gues you best join the French Foreign Legion - do that then they will never be able to trace you, when you leave after 5 years you will have 1. a french identity, 2. a new skill and about 100,000 Euroes in the bank…

$24,000?

Mate, you’ll have no problems there, get in touch with your creditors, I don’t know abot the USA, but in UK you would be able to sort out an IVA with creditors and banks and pay like $200.00 per month on that amount.

You are worrying too much, but then again we all do about debt because it is totally stressful, and horrid situation, especially with the current ecconomic climate.

Did you file pro se or did you use an attorney? Your best bet is to find additional work to support your plan payments. Otherwise, the court will dismiss your case and your creditors can sue you, get judgments against you, and take your property. I suggest you contact a bankruptcy lawyer and see if you can get your Chapter 13 plan amended to reflect your new income and possibly set a new monthly plan payment. Otherwise, look into filing bankruptcy in Austrailia…?

Also, have you considered a credit counseling agency? Or contacting your credit card companies to do settlements? You can go to http://www.usdoj.gov/ust/eo/bapcpa/cc… for court approved credit counseling agencies.
