My boyfriends job is breaking the law.
He is a tow truck driver. His boss pays him about 10 dollars an hour for 40 hours a week. The problem is he works WAYYYYY more than 40 hours a week. He has to be at the shop from 8 to 5:30 every day of the week cept thursday. After 5:30 he is on call. All night. He gets about an average of 3-5 calls a day after 5:30 and he is never home because each of those calls take long enough that he usually gets home around midnight or later each night… sometimes he is woken up at 3am for a call.. or anytime really. He dosent get enough sleep and its dangerous for him to drive like that. All of their trucks are in bad shape and wont pass inspection, and their trucks are not registered to do tows out of state but they do them anyway. There is also a truck driving law that you can only have a driver driving for a certain amount of hours a day… He drives way over that limit. Now if he is on call all day and is “engaged to be waiting” instead of waiting to be engaged… then he gets paid for every hour he is on call waiting for a call. which usually dosent take long. I did the math… according to how many hours he is working and how much is check is.. he is making about 3.50 an hour. WAyyy below minimum wage. If you want to say that he’s getting 10 dollars an hour for 40 hours a week, then that must mean that he is doing the after hour on call tows for FREE. He is exhausted frustrated and we are both sick and tired of never having time to see each other. We live in the same house.. the only time i see him is when he comes home at night for a few minutes before we fall asleep and in the morning for like 15 minutes while we both get ready for work and head out…. there has to be something we can do here. He deserves to be compensated for the hours he worked and didnt get paid for. He should be making at LEAST 1400 a week right now he is making about 425 a week… minus taxes.. equalling about 380 or so. We don’t know what to do because we need the money, neither of us can afford to lose our jobs and this job is supposed to help him become an OTR driver (he has a class A CDL liscence) by providing experience… but he isnt getting paid for his time and now he has no life to himself… not even to take a shower, eat dinner, and get a good nights rest…. OH and sometimes he dosent even get a day off. WTF!

I would talk to his boss. If you don’t think you can do that, talk to your husband about it. I’m sure he doesn’t like being on duty practically 24/7. Cause if he is working illegally and knows it, if the government or inspectors find out, he could be fined, whether or not he is getting paid for the extra work i beleive. If his boss doesn’t listen to you or your husband’s request, then he could quit the job. Truck drivers are becoming high in demand.
I agree with Kyle, you can also go to an agency and report that crap because thats just plain wrong.
Well here is the thing - no amount of money will bring him back when he causes a major pile-up that kills him and a few families in the passing. So it is time this nonsense stopped - dont care you have to move to the other side of the country to fix this - there is little point in him complaining to a corrupt boss (I wish there was - but it isn’t so).
Put your foot down - it is time your man was out of there - if you ever do one thing for him - get really serious and find him a new job - you will manage together - just put your mind to it - this is deadly - Mas

Well why dont you start looking for him - you know his resume and you know you love him. Dont let this be - stand up for your man - and I’ll tell you what - anyone I can think of who can help you here will do just that. You have shown a genuine concern tonight/today (sorry time difference - I’m in UK) so run with it. Come on let us know what state you live in (no personal details obviously) and see what the guys/girls on here can suggest. You may even have to make a new post called “I love my man - but his job is killing him’ - come on - let us help you and him. My suggestion is he find another job! Don’t make any waves with the current company b/c he’ll need the reference, but maybe you both can research similar type jobs that have less insane hours?
Then, when he’s got the new job, I would report this company at least to the better business bureau in your town b/c this does indeed sound unfair, and more importantly, dangerous to the workers and all the rest of us on the road!
You are on the right track to be upset about this, so arm yourself with knowledge and find a better job for him. He sounds like a very hard worker, so hopefully this won’t be too tough!
Sounds like the company is violating the Fair Labor Standards Act. Of course, to succeed in a lawsuit would take years. Your bf needs a new job. Or . . . he could get a Small Business Administration loan and buy his own tow truck . . . or two . . . or three, and start his own company.
One problem. He has a felony that his is just now getting off probation for.. but since the charge (which was when he was 18 and now he is 21) he has gone to school and gotten his class A CDL and been perfectly clean and persuing his career… but that still holds him back from certain jobs.
I have been trying to search for jobs for him.. every day I do. I just wish there was some way he could get paid for what he HAS worked and wasnt paid for.. it wasnt worth it to go through all this hell. He deserves to get the money he worked/works for.

i dunno… anywhere i guess.. we would just need to save money to move and get a place to stay until he started getting paid i guess…
he wants to drive OTR but right now any commercial driving job is better than this.

I agree whole-heartedly about all of the risks, and would love nothing more than to get out this job and get started on a real career, but there is nothing around here for my kind of work without have the perfect pedigree and both a pristine driving record and criminal record. Well maybe it’s time you aproached the agencies that place felons and stop trying to pretend the past didnt happen (that is not an insult - it’s a good suggestion - those agencies have a lot of money behind them). If there is anyone who knows of any companies that offer over-the-road for felons, I will take it no matter what else is needed. All I want to do is drive a tractor trailer. Thats why I got this job -for the experience- so that I could go to these companies and drive for them.

~5000 miles (Logbooks are not required for this company)
And I’ve towed many things with GVWR of 30,000 pounds or higher in a truck with a GVWR of 80,000 pounds.

Well, he just left for another call. He’s so pissed >_ Its storming really bad here some lady locked her car with it still running and a kid in the car and the other driver who is closer to the tow made up some story about how he’s in traffic and can’t do it. He really just needs to go to sleep.

We will definitely be checking back tomorrow. I have work from 7:30 to 3 and he wont be off till 5:30 but he dosent usually get home by then… its very hard to find him actually home and able to do ANYTHING… thats why i’m trying to help him out and find help/oppourtunities online. You can actually search the Better Business Bureau’s site and find truck driving companies that have good records with them. I didn’t look into which ones accept records or not because I don’t know the City you live in, and I don’t expect you to put it out on the internet.

try applying for smaller companies. Jb Hunt Schneider and other big trucking names probably wont hire you but a smaller company will. In most places you can 10-20 dry van companies willing to hire just about anyone. Once you have a year or 2 worth of expereince the bigger companies will hire you. Otherwise try some construction companies. The road and utility construction companies routinely hire for equipment movers and water truck drivers. Most require a CDL and drug test only (not even a high school diploma needed) and routinely hire people with criminal records. Another place to try is your trucking school. They may know of companies willing to hire you. Some companies actually have policies not to hire new graduates of trucking schools and this may be part of your problem. Try circummventing it with experience in a related field.
