I lost my job due to absenteeism in Mass.

The company was on a point system, but never gave any of us a written description on how it worked. Everybody was walking on eggshells. People recently, were dropping like flies. I think they are trying to cutback and get rid of the overnight shift.
I applied for unemployment 3 weeks ago…no check, no determination. When I called the unemployment office on Friday, they said my employer had an “issue” with the claim. They transfered me to “someone” that was working on the case. Left a message. No response yet. Nobody has requested any information from me.
I really need the money to support my kids. I have zero!!!!
Isn’t someone supposed to tell me something by now? or does it look like I’m just denied, if nobody contacted me?
Any Employee Attorney’s out there? Please help. I’m screwed….

When I was fired, I asked them about unemployment. They said they knew nothing about it. Never gave me a pamphlet, I found out later, they were “required” to do. So, I found the number myself. I know they will fight my claim and anybody else they fire because they NEVER cared about their employees. Thus, I won’t call them.

Too be honest, I’m really afraid to call unemployment again. I’m afraid they’ll have bad news. I’m just praying….

I’d say call unemployment again. I don’t see what option you have … since your former employer won’t help.

You have a right to unemployment benefits if the fire was NOT due to your negligence.
It seems you were fired because of a “point system” that was set up by your company yet was never explained well to employers. You should have been aware of these if they were to someday cost you your job.
Not your fault.
So call them again. They should have some information for you by now. And it should be in your favor

That sucks! I agree with the statement above, “You have a right to unemployment benefits if the fire was NOT due to your negligence.” If you and others did not actually knew what the “point system” was, then get them involved as well. What the company, whatever, did is an injustice. Yes, indeed keep calling them and DEMAND your benefits. Actually present yourself in their office. What I would do is day and night look for a job, you have your kids to look after. Im not married or have kids. But, I have brothers and certainly I wouldnt like to see them hungry.

Thanks everyone. I started looking for a job the first day after I lost my job. Posted and sent my resume to Monster and a number of other sights, registered with temp agencies and childcare agencies. Search, search, search is my job now and every minute.
We also asked repeatedly for a written explanation of the “point” system, we were told either they’d try to get it or we’ll get back to you. They are the sleeziest company I ever worked for. By the way I’ll tell you…it’s the Christmas Tree Shop!!!! Owned by Bed and Bath now. Don’t ever let anyone you care about work for these companies. Slavery is still very much alive. They have NO regard for their employees. They’ll really use and abuse you. Especially if you get full-time benefits from them. (You won’t now.)
People that are working there now, say it’s hell on earth. They now are down to the barebones, because of all the firings. But the work load remains the same. People say, I hope I don’t die here…they push and push and push…Some of these people are in their 60’s lifting boxes 50pds plus all night long. They already fired all the men.
They really need people to be aware how cruel they are to their employees!!!
It’s just so wrong.
Well. I called unemployment again and they told me the employer was protesting my claim and that I will get a call for a statement of what “happened”. I do I explain all this? I know they’ll have a big attorney representing them if I go to a hearing. How am I supposed to get an attorney with no money?

Contact your legal aid society. Ask for a lawyer who may take your case on a contingency fee basis (lawyer wins, he/she gets paid; lawyer loses, he/she doesn’t get paid). Big companies will roll all over you if you don’t fight back. When they get a good idea that you’re not going to lie down and roll over, it’s a completely different ball game. You might tell your former employer that you may just decide to picket their store while your claim is being decided . . .

The bigger companies are the worst. They know they can take you to court and more than likely win. This is terrible. Don’t give up! Keep fighting. You are a human being not a robot.

Thanks for the great advise neku! I will definetly check them out. I still have not gotten a call, letter anything from unemployment (4weeks later)! They only told me to wait for a call. I called them twice, they told me they are very busy and not to call again til Fri. She’ll get to me when she can?! Are you kidding? I’ll call again tommorrow.***If there are any unemployment attorneys in Mass out there that can help. Please let me know. Pro Bono basis? I just had a previous co-worker just email me and the word is at the company, is that anyone with benefits is next! The stress there is unbelievable! There are only a few people left that were’nt fired anyway.
I am sooooo ready for the fight of my life!
