im the service member i got married before i got in the corps and after all my training i came home and he was with someone else we tried to work it out but its a no go. so now im wanting to move on and let go but i really need my BAH because i inherited all my grandmothers furniture so i have that and my own living room set i pretty much have an entire house full of things, and im renting to own this place i have got a roomate that helps out but everything here i own

That helps. OK, if you are divorced, you will lose the BAH unless you are allowed to live off-base. I think you have to be an E-5 at least for that to happen. WHILE you are still married, you MAY be required to pay the jerk the equivalent of your full BAQ. You should consult a JAG legal advisor. If the bird is your dependent, and under military law he is, he could demand the equivalent of the BAH. The BAH is the “minimum” in spousal support you could be required to pay.

Talk to a JAG lawyer, not just a clerk or NCO. If your cheating husband doesn’t KNOW he could be entitled to your BAH, so much the better.

P.S. One last bit of advice . . . be SURE you don’t get caught in a situation where you have to PAY BACK your BAH to the military. Ouch! So be sure by talking to JAG!
