There’s a warrant out for my arrest.

I’m from the midwest! I’m a sweet girl!

I moved to California a year ago, got an apartment, got a job, and promptly started living paycheck to paycheck. I didn’t register my car. I couldn’t afford to! Then I started collecting parking tickets: 5. I couldn’t afford to pay them either. I got pulled over a month ago and was cited for having expired registration and was to appear in court this past Friday. That’s okay, I thought, my lease is up in August, I’ll be homeless for a month or so, save up the money, register my car, and all before the deadline. Then I learned that you need to have an address to register a car. ****. So I found an apartment, moved in, and made an appointment to register my car, but the only one available was tomorrow AFTER the Friday court date. I’m also in school: I’m finishing my last course for my degree and Friday was the first day of school. I could have gone to court without the registration, had my car taken and missed class and my chance to register for IT and have to wait another year to take it(long story), or I could go to class. I chose class. Now there’s a DMV hold on my record which prevents me from registering my car, and a warrant out. I’ll go to court tomorrow (in a rented car so I’m not breaking the law) and they’ll make me pay bail (who knows how much), the $1000 fine, an additional fine for failing to appear, all my parking tickets, and of course the court fees to punish me for not being able to afford to pay a fee in the first place, and if I can’t pay they’ll send me to jail for six months. Assuming the total cost is less than or equal to the $1400 I have in my checking account, I’ll be able to pay it but I’ll be left dead broke and unable to pay car registration (the original problem!), rent, phone, tuition, or groceries. Since I won’t be able to drive my car, I’ll have to scratch together the $60 for a bus pass and loose hours at my jobs since it’ll take me twice as long to get to class. All of this not helping the problem! I already qualify for welfare but won’t take it because I feel it’s better to work for my money, live on a budget, and study so eventually I can live more comfortably. Since I didn’t apply for welfare but qualified this whole last year can the state of California and I just call it even?

Why is it so hard?

Go collect your welfare, who cares what people think. And I don’t think they’ll send you to jail, for six months. That’s probably the max. Jails are way overcrowded, especially in southern California. Just talk to them and they’ll work something out. I think they have payment plans for things like this.

They do have payment plans?? Oh my gosh, that would help so freakin’ much. I did just get a good job! I’m not a delinquent, I promise!!!!!

I’m almost certain they do. Also, they aren’t going to come looking for you to arrest you. Make sure you drive safely, because if you get pulled over they will find out you have a warrant. Otherwise you won’t be arrested.

In the event you are arrested (highly unlikely), you’ll see the judge the next business day and should probably ask for an OR release, which means they’ll set a court date and you can go talk to a lawyer or the public defender or whatever. It’s unheard of for first time nonviolent offenders to get jail time in SoCal.

I’m not a lawyer, so consider this friendly advice, and contact a lawyer if you want to know for sure.

Do you think they’d lower the fines because that was the problem in the first place? Or will they be pretty heartless? …I’ve heard that LA cops beat people…

I don’t know if they’ll lower the fines, I kind of doubt it. There are a lot of bad cops in the LA area. But they usually don’t mess with people, unless they think they can get away with it. If you are a white female (sorry, if I’m making a bad assumption, but you said midwest) you are much less likely to be messed with, especially if you look like you have a job. No problem.

One more thing, try to avoid driving late at night. You are much more likely to get pulled over then.

Dear Midwest Girl,

Right now you are lurching from problem to problem. Stand back and take a look at the big picture.

You can’t afford to have a car. Give it up. It’s much cheaper and green to take the bus. Be a leader in the green revolution. Take your books and use bus time for study time. Improve your grades.

Make it a goal to get geographically better arranged. If your priority is school, find both a job and living near school to minimize commute time.

Make better choices based on long term consequences. You chose to go to class in exchange for a bunch of new problems. Bad choice. Get yourself clear on the legal stuff. Tell the judge your situation, you made some bad choices, but you are a good, upstanding person and have learned your lesson. In the worst case, you can get a payout on any fines imposed. Stay in touch — it you have to miss a payment, call and explain.

Stay out of trouble and you will succeed!

you are doing all that you can to survive which is ALOT more than MANY people collecting welfare. get it use it until you don’t need it then you will become a positive tax paying citizen and will be paying back the system with your taxes then your debt will be paid so it is not like you are bumming money!
