I recently moved and I’m still moving and trying to get adjusted. The school knows this and I take him myself to school everyday. My son has been tardy 4 times for the month of September and all those times I have been there to tell them why. His school sent me this letter saying that my son is truant (8 yrs old) and that I need to tend to parent classes that they have there… and school just started in mid September and He’s not missed any day. They also put on the letter that I might need to go to a district attorney. I saw that the code this school is writing to parents, is defferent than all the ones I searched on the web. They are totally changing the code and I don’t think that’s right. I am going over there to let them know but I want to know if it is a crime what they are doing so I can tell them,… but what would you call it if it is a crime?

The school wrote “Education Code Section 48260, states any pupil subject to compulsory full-time education or to compulsory continuation education who is absent from school without a valid excuse more than three days or tardy in excess of more than three days in one school year, is TRUANT and subject to prosecution.”

And on the CA DEPT OF EDUCATION it reads as…
Any pupil subject to compulsory full-time education or compulsory continuation education who is absent from school without a valid excuse three full days or TARDY or absent MORE THAN ANY 30 MINUTE PERIOD DURING SCHOOL DAY WITHOUT A VALID EXCUSE ON THREE OCCASIONS in one school year, or any combination thereof, is a truant and shall be reported to the attendance superivsior of the superintedent of the school district”.

I have no idea what it would be called to be honest. If you really think it’s necessary to know before you go and meet them then perhaps do talk to a lawyer and get the facts before the meeting, you could always go and talk to them, see what they have to say and then make a judgement about whether it’s worth following up or not afterwards?

First of all, you have to remember, what you consider a valid excuse, the school may not. Second, if you give my the county you live in, I may be able to find the code for that county. Before bringing this up to the school, check the specific school policy. Most school boards will allow the schools to take care of it themselves. Just let me know the county and I will look it up in the state and county sites>>>>
