Is early voting constitutional?

In the US Constitution, it says that election day, for general elections, is the first tuesday after the first monday in November. It says nothing about early voting. Does this make early voting none constitutional. We don’t even reschedule voting for severe weather, why do we do early voting??

There are a lot more people voting in the US now than there were when the Constitution was written. Eventually you’re going to have to allow for more time to be able to accurately count everyone’s vote.

true but the constitution should be changed to go along with this. That way no one brings up the fact and takes it to the supreme court when they lose an election.

I thought it was in the constitution, but it is actually a federal law passed in 1845. But anyway, it was never repealed. So is it constitutional to allow early voting? since it is a federal law still in place that the voting takes place on that day.

Either way is it still constitutional to do early voting with no repeal of the laws already in place?

sorry about the mistake. My original question is still valid due to the constitutionality of the subject since all federal and state laws must be constitutional!

It depends. If you are a strict interpretationalist, then you believe that if a subject is mentioned in the Constitution, it should be followed strictly to the Constitution. If you are a loose interpretationalist, you believe that if it isn’t specifically disallowed in the Constitution, then it is legal to do it.

I think it should be unconstitutional due to the fact that a lot can happen within a campaign right towards the end. If something happens then you have already cast your vote and can not change it. Eventually this could get the nation in trouble, especially if a candidate, knowing very well, he is going to win changes his mind at the last minute.
