Is this illegal?

I’ve been selling random lots on ebay. They have a chance to win something or something else. Is that illegal? Can I get arrested?

Are the things within your lots stolen merchandise?

no, they aren’t. But people can bid up to like 70 dollars and may receive something that isn’t worth much.

Well, as long as you are not lying about the products…

I had a friend who sold an Ipod BOX on ebay. He made it clear at least 3 times that it was just the box and not the Ipod. But it sold for like 200 dollars.

Don’t lie about the quality/quantity of the merchandise and you’ll be safe

EmilyRI, you’re friend is smart if he pulled that off! Ebay ppl don’t think too clearly I suppose.

Yeah, they often see the product and ignore the description. My friend didn’t take the money though. He just wanted to see if it would work.
But I’m sure there are a ton of scammers out there that know people won’t usually read the entire description before bidding.

I believe that the bottom line here will be if someone challenges you on this, how do you think a group of people will react to this.

I would ask an attorney. The term reasonable expectation is one that I heard a lot when I was in law enforcement and we were in the courtroom. Did the person have a reasonable expectation to believe that they were getting something?

Ask yourself, If I were on a jury, would I think that this was wrong?
How do you think six or twelve people will react?
