Family help: I live in West Palm Beach, Fl and my family is being evicted tomorrow if we do not pay our rent. - Help.com

I live in West Palm Beach, Fl and my family is being evicted tomorrow if we do not pay our rent.

My husband was laid off of his job of 5 years and I have been at home since we recently had a baby. We have two other children.

He has found another job, however, he won’t get paid in time to stop this eviction. He starts next Monday! I am so overwhelmed. We are hard workers and it seems that everything is falling a part. I am trying to keep my faith, but it is difficult.

We have contacted every agency and unfortunately, there is no help available. If anyone can help or know of where we can get help from, please let me know. We are desperate!

1. Weird that rent is due on the 18th

2. Eviction process takes upwards in the area of 2 months.

3. If you get kicked out tomorrow call a lawyer.

Plus you have a day in court, or a request to appear.

Have you tried contacting the rental company?

If you have an illegal lockout and eviction, you can take the property owner to court, which doesn’t help you much right now—but there isn’t really a lot any of us can do.

West Palm boy oh boy thats a pretty high end part of Florida you may need to find a less expensive place to live.

West Palm isn’t as glamorous as it sounds. You’re thinking of California. I’ve been to both towns. Anyway, there is no way you can legally be evicted tomorrow unless you’ve already been to court over the matter. It has to be a 30-day notice if I’m correct, and then there’s another month after that before you have to vacate. My brother and sister-in-law went through the same thing not 2 months ago for a stupid reason to begin with. They’ve moved, but they’re still arguing the case because it was an unlawful eviction.

Unless you all are lawyers you have no idea what you are talking about.

1) landlord posts a 3 day pay rent or quit notice That means pay or get out-

2) if you went past that he goes to the court house and gets the 30 day evication
notice where

3) you have your day in court to explain why you are behind in rent

4) if the judge rules against you you have 7 days to vacate

5) Nothing else can be done

6) the only loop hole is if at anytime durring this process the landlord takes even a dollar bill from you he forfeits the eviction notice and he had to start all over again.

I hope this clears up the why he is moving on the 18th he must have been given extensions by the landlord. The landlord is at the final end and wants him out now. It will give him enough time to ready the apartment or house for December rental. Plus the landlord now will be able to go to civil court and file suit for the months of unpaid rent, damages and what ever else he can come up with. And it goes on your credit rating.

Anonymous it depends on the state you live in, as state by state, for the majority, your land lord must send you written notice, file with the courts, the day in court happens and then (generally) a sherrif posts a pink (sometimes orange) notice on your door stating the actual date of eviction.

What most of us don’t understand is IN THE TIME IT TAKES to process—what were you doing? Why do we constantly get the “I need $XXXX or I’m getting evicted…” when obviously you knew at a minimum that you didn’t have the money for rent in the first place.

In Florida given everything goes in the Landlords favor, due process is about 2 weeks. However if this family went to court, it is quite possible that they would be able to mitigate the pending eviction, given that there is a family with newborn infant, and that they pay fees and are put on a schedule. The family had two opportunities (once when served with papers from the local jurisdiction *5 days, and once again in court.)

But did they at any time get the landlord from the first sign of trouble did he take ANY AMOUNT of Moneny? Even $50.00 he takes he has to start all over.
