I have a question.

I recently received this item from ebay. The item was in ok condition, but the tag was bent and it looked like the stuffed animal had been played with while the auction stated it as new. I opened a dispute with paypal since I feel I should get refunded for my purchase. Do you think that was the right descision? Do you think I can get in trouble with the law for that or am I overreacting?

I haven’t heard of paypal caring about matters like that, but maybe they’ve changed over the years. It does seem more of an ebay issue.

Follow the guidelines on the ebay site precisely. First you need to make the seller aware of your concerns and offer them the opportunity to put it right. Normally, a seller would tell you to return the item before sending a refund. The return is usually at your own expense unless the seller has specifically stated otherwise in the sale details.

You are perfectly within your rights to invoke the paypal complaints facility where a seller does not respond to you or responds negatively, as long as you have followed the ebay procedure precisely.

You should talk to the seller before opening a dispute with ebay or paypal.

You should always contact the seller before you make a claim with Paypal. They may have refunded you themselves and you could have avoided the dipsute. I mean, no seller wants to recieve a negative feedback comment over one item, generally they will refund. Not all co-operate, and that’s when you resort to lodging a claim.

Now that the dispute is open, I doubt the seller will be too keen to negotiate.

From here, the seller will have 10 days to respond to the claim and give your money back. If he/she does not respond, you will automatically be given your money back by Paypal.

May I ask how much the amount was ? Or was it really expensive ?

You can’t get in to trouble with the law, you haven’t broken any rules or done anything wrong. The dispute console is there to lodge a dispute when your not happy with an item. Theres no rule to say you must try to negotiate with the seller before lodging a claim, it’s just kind of like “eBay ettiquette”.

Is this the first dispute you’ve had ? It’s all a learning experience. If you do ever have another dispute, you will have learned from this one, how to go about it next time.
