We will be homeless as of Christmas Eve if no one comes to our aid.
The “eviction” is not due to non-payment but to a “holdover” clause in lease. The reason this became an issue is because my apartment mates did not have a good relationship with apartment manager and consequently the apartment manager had us evicted.
There are some technical grounds in lease to terminate, however in Los Angeles, subletting out space in order to pay extremely high rent is common in most instances.
In court the apartment manager lied to judge in saying she had never received payment directly from me and that my name was not on lease.
Not only were payments on-time, the manager made us pay late fees directly to her (we have checks to prove it) during the top of our rental period when payment was made on 3rd of month instead of 1st. We stopped paying late fees and thats when our relationship started spiraling downward.
In fact she threatened that we were on our own and she would not cover for us anymore. (at time we had no idea what she meant since we made our payments). To make story short, the sheriff will be here on the 24th to ensure we are out.
Imagine that 4 people displaced on Christmas Eve in California (largest homeless population in country) and why?, because the apartment manager has the power to do so? WTF is that?
We have talked w/attorneys who said we can sue the company but for now time has run out. We even appealed to management to allow us to at least move by 1st of January to no avail.
Also, in the state of california there is a bogus housing judgement on record with our names until we get through legal process to have it removed. Please, somebody must have some idea of what we can do.
