I’m being sued for defaulting on a car loan.
The car was repossessed last year around this time. I had been paying faithfully and on time, but then moved, and ended up using all my money to move. I missed 2 months and they repo’ed the car.
At the time I did the deal, the salesman said that it was a build your credit type program, and in a year and a half, I could come back and pick a newer nicer car for lower payments, since my credit will have improved. I came back three times a year and a half later, and all they ever said was “Not now.” And afterwards, I’d get like 10 credit rejection letters in the mail.
Fast forward to about a couple months ago. I get a letter in the mail stating that “It’s time to come pick out your new vehicle!” Its from the dealership.
I signed the contract in April of 2006, and was still paying on it up to February 2008. I was not supposed to pay on that vehicle that long, based on what the salesman promised me. But the problem is, I don’t have what the salesman actually said in writing…only the contract.
I do have that letter, however, which proves that I was supposed to be able to come back and get into a better vehicle with lower payments.
They’re suing me for over $6000. I’ve paid $150 TWICE a month ($300 a month), from April 2006 to Feb 2008. The car is listed in bluebook for like $2500.
Who’s help do I need to seek? I don’t have much money for legal help. I can’t afford wage garnishments. This vehicle has been ruining my life since I got it. I just need some advice.
