We haven’t met before but I have been helped by your
firm with my case in the past the Solicitor that helped was MS B as my funds were limited even then I did most of the running and info gathering and Lynda did the Law bit. I have been going round in circles and I desperately need help. I find myself in an awkward position as I am not working (I am on Income Support) but my dilemma is that I have a Property that has equity of more than £100,000.00. I can not sell it as My ex partner has an Application on it, and now has applied for ancillary relief from me.
This is the biggest joke of all he is claiming that he only earns £9,000.00 per year, he actually earms between 3k to 4k per month (he is self employed and has taken to hiding his equity.) we are due to be in court on the 30th of June. I have completed an E Form and filed this but I really need help with the other bits that I will have to put into court i.e. a concise statement and a Chronology and a questionnaire for other documents that I require from My Ex’s Solicitor, and a Notice in Form G. ( I am stuck). (he has applied for a divorce on the ground of my being an alcoholic, so I have refused to sign this as I am in no way an Alcoholic (he is a muslim ‘ not a practicing one though’, The last Judge said if I disagreed with this to put in an application on the grounds I believe our marriage broke down so I am.( I have included proof of his domestic violence that was proven in court by a judge in 2007and his Infidelity.)
I am putting in an Application for Divorce and a Non-Molestation Order and a Prohibited Steps Order again, as we are currently in dispute about access over our daughter because my Ex was Extremely Violent towards me and also put his child at risk, Social services were involved and Cafcas. I have also put in an Application for Leave to remove from jurisdiction (I applied for this after receiving his solicitors letter stating that they were no longer reprecenting him and he was withdrawing his application for contact.) My family has cancer and lives in a place and I wished to move there but in the last conciliation meeting the judge refused to even give me a date for my case to leave to remove to be put forward. I was told that I would have to wait till my Ex had finished the DVIP course and go through the final contact hearing to see before I would even be granted a date for my case to be put forward.
My Ex has been warned in court on two separate occasions about his breach of the previous Non-Molestations orders. He has had us watched followed and stalked by different people and he even had the cheek to laugh about this in court. no power of arrest was attached as he promised that he would not harass me. What a Joke.)
My ex Partner is currently attending a DVIP course at my insistence as he broke 7 bones in my body and I don’t want my child or anyone else to suffer at his hands.) this is his second attempt at access as he didn’t turn up for the previous one and the case was dismissed. Even this application he has been on and off with I have a letter and so does the court where he stated that he would be withdrawing his application for contact. But when he arrived in court he changed his mind yet again. He currently only has Non-Contact via letters, cards and gifts sent to my mums address only. The last card he sent my daughter in it was a statement saying ‘ ONLY HE CHARTERED THE PROTECTION LEFT TO THE ANGELS FOR A WHILE’.
My only asset is my home and really need help , My sister told me about a loop hole in the Law that was used by your firm in her Divorce Case and I wondered if my case would be able to be assisted by this loop hole. I Currently have no savings and I am only able to ask at Citizens Advice bureau on so many occasions. (I really need help I am fed up being bullied and pushed around by his solicitor because they know they can get away with it.) I am stressed to eye balls.
I Have spoken to MS B but the first thing she asks me is if I have her fee, I don’t have any savings except the equity in my house, but I really need help.
Is there anything you can do to help me please.
