and can the bank be held responsible for it, or is down to the borrower.

if you sign the contract, you are basically stuck! have a loan contract reviewed by a knowledible source before signing the contract. if you sign it, you are basically relieving the Lien holder of responsibility.
make sure you understand the interest percentage before you sign the contract!
