i need some opinons.

im 21 now but when i was younger idk how it happened but i somehow got a very small watch battery stuck in my ear and never knew it was there. i remember going to my docter about 5 or 6 times over a 5 year period and he always said it was just a clogged ear even though i had alot of pain, and then one time it got so bad they had to use like this ear cleaning machine and a battery fell out. what im getting at it i have really bad hearing lose in that ear and have to wear a hearing aid, can i get some kind of compinsation, how would i go about doing that. I remember going there several time and he would look in there with the ear scope and everything and misdiagnosed me about 5 times and now im having hearing trouble and my ear always hurts, please any help would be really cool

i think u need to call a lawyer, explain it to him / her. if it wasnt ur fault that the battery got stuck in ur ear i think u can get compensation. i think u need medical records as proof too

How long ago did you get this out? And if your doctor actually did an inspection and was not able to see it, I don’t think you can get any compensation. He did not put it in there for you. There is a statute of limitations and you have to prove that he misdiagnosed you regarding that. You’re going to have a hard time finding a lawyer to take your case unless you give them a retainer upfront. Most lawyers will not take a hard to prove case on contingency. Good luck!

No I don’t think you can for something like that, I mean it was you that put it in there, it was not a virus that was misdiagnosed or a surgical instrument left behind it was something you rammed in there that a doctor is not going to automatically assume would be there to look for, fact is, you are lucky it got found when it did, I mean you could have had life long troubles with it but instead you get away with hearing loss due to an idiotic thing you did when young so hy on earth you want to get compensation off someone else for something you did is beyond me.

I didnt know it when in there and I went to the same doctor 5 or 6 times and he said it was only a minor ear clog and or infection

Yeah, he was right, it was an ear clog, you had a battery clogging it up, not his fault that he didn’t assume you were stupid enough to put something like that in there and even if he thought you were that stupid I am sure he would just assume you would remember doing something so random and tell him.

I am totally chilled actually, thanks.
And I am not ranting, I am trying to get my head around your post.
You tell us you stuck a battery in your ear that caused you pain over a few years and you want compensation because your doctor did not think to suspect you may have stuck a battery in your ear and then you go and call someone else stupid.

Bottom line is any lawyer that takes your case will ask you for money upfront because he will see that the chances of him and you getting any money out of any doctor or insurance are slim to none and Slim left town a long time ago!

I wasn’t even being rude or nothing..
I can offend someone without even trying that has to be a first LOL

But anyhow, your idea of compensation is bad as a doctor is there to heal people and help them, not to guess what objects they may have shoved into what part of their body but I suppose there are people out there who will do things like that.

Ok, you are really getting boreing now, I AM not being sarcastic or negative, you asked and you got an answer.
What is your issue?
Yeah I found it funny that you got something stuck in your ear, I mean who wouldn’t, it is an odd thing to do and also to want compensation for it.
But you are the one being rude and nasty here, you ask for advice and when you are given advice that you don’t agree with you call someone stupid and then tell me to chill out when I am not the one being highly strung and immature.

Now this is a help site, your either want help or you go away, if you can’t listen to both sides of the advice then don’t go accusing other people for things they are not because you can’t deal with it.

yea i didnt come here to be told how stupid could you be to put a battery in your ear, and hows that the doctors fault, one i didnt know it was there and two how doesnt a doctor see a battery in a ear even useing the scope that goes all the way in your ear and looking at it mulitple time over a 5 year period how stupid could the doctor be is more the question

ok, now we are getting somewhere!

Well for a start, the battery would have been there for a few years before a doctor looked at it, in that time it would have had a chance to slip quite far down the ear cannal even resting against the ear drum, also any forin (sp) object will immediatley set off your bodies immune system and your body would try to fight against it, that would cause an excess amount of ear wax and also imflamation.
When the doctor looked in your ear all he would have seen is alot of swelling and alot of wax and maybe raw skin and that is all indications for an earinfection, the wax and swelling would have hidden any object in there unless it had a neon falshing light on it.
The fact is you should be thanking your doc for finally getting it out with the little damage you have as it could have been there for more years than it has already causeing more pain and maybe more damage.
Anything like that would not have been seen with a scope or not, only way would have been a scan or an x-ray and as it was your ear there was no need for that unless you were haveing head and brain issues.

a doctor can *not* see a battery if the passages of ones ear are obstructing the view. so then it is safe to assume that it is not the doctors fault, but the fault of the shape of the interior of your ears
