financial help: Can I remove garnishment from my pay check? - Help.com

Can I remove garnishment from my pay check?

I work part time in retail. No commission at 12/per hr. I work between 20 to 30 hours per week. 15% of my paycheck is being garnished from a student loan and as of today 25% will be garnished in addition from the DMV. Doing the math, that will roughly leave me with $110 per week. Is their any way to remove at least one of these garnishes from my pay check? There is no way I will be able to survive otherwise.

i only know my UK PAYE law, not US…

but here, student loans are based on an amount above a certain wage, if you earn under it, there are no charges - but you also cannot get out of it…

as to the DMV - what is it for? - if you need to get out of it, you need to talk to them - see if you can ask them to reduce it (its better to have a thin slice of a cake often, than 1 big slice, then nothing else…)

there is also a rule that prevents too much being taken out at once - but thats UK specific (known as the regulatory limit) - unsure if there is something you can use in US law

Usually, you cannot have 2 garnishments if it is going to make it where you cannot survive. You will need to contact both places and see what you can do. Usually, 1 garnishment supercedes the other. Ask your job to give you the paperwork they received in regards to your garnishments. If they didn’t give it to you, they are in the wrong, as well.
