TPO, Battery (DV), Cruelty to Child (3rd degree)
My mother was abusing her prescription pain medication and has mental issues. I took her into my home to save her life and my 14 yr old brothers. I did this even after she left my daughter and I homeless when she was only 3 after her boyfriend sexually assaulted me when we left my husband due to domestic violence. On August 8th she started pounding on my bedroom door and cursing and screaming in front of my 7 year old daughter. I opened the door and told her she need to calm down and that she needed to watch her behavior and what she said in front of my daughter. My husband told her the same and that she needed to go back down stairs and calm down. Then she hit him in the chest and I stepped in between them and she struck me in the chest. Then I managed to hold her arms and back her out into our hallway. She then freed herself and began hitting me again. I put my arms up to defend myself and her eye got struck in the process. As that happened my 14 year old brother came upstairs and I yelled for him to take her. She then began to hit herself in the eye and called 911 and I got my daughter out of the house and dialed 911 as well. The officer said that he was taking me to jail. I spent 24 hours in jail. I have obtained and attorney that agreed to cover this TPO case and the above charges for $7500. I have a court date for the TPO on 8/25/09. My court date for the charges is 9/18/09. Now my attorney says he will not cover the TPO case even though that is what he agreed to do. Now my mother has called harassing me and have had others calling to harass me and my family. My daughter, husband and I are living in a hotel and are not able to return to our home. Please let me know what you think I should do to gain representation for the TPO so that I can have it reversed on her. She has a history of mental illness and violence. She lost custody of my brother for abusing drugs and had to take 6 months of anger management. I cannot have contact with her or my brother and I fear for his safety. Also she coaches him on what he has to say to his counselor so I am sure this will be no different. Please help as I am desperate and am out of money. Thank you so very much. Oh and the social security number listed on the TPO is not mine, it is my fathers. Can I get out of this on that technicality? I am feeling totally alone and railroaded by all.
