my fiance hase been in the navy for almost 3 years.

he has never gotten into trouble until july of this year when our exroommate(who got kicked out of the military) filed a false police report against him (while he was high). since then our exroommate has moved to TN and checked into rehab for pot. when his chain of command found out about the assult charges they sent my fiance to mast with thr recommendation of administrative discharge by quickest means possible. this is his first time ever going to mast in almost 3 years of service and he had a 6 year contract. when he went to mast the XO presided as the CO was on leave at the time. i was there as a wittness but i could tell when i went into the room the XO already had his mind made up as to the punishment he was going to give. the XO gave the punishment of 45 days restriction to the ship, 45 days extra duty, loss of his NEC (nuclear clearance) reduction in rate from E-5 to E-4, half months pay x2 (suspended due to the fact that we have a child on the way) and he left the decision to the CO when he returned from leave as to whether they were going to discharge him or not. well it took the CO almost 3 weeks to make the decision to adsep him. he is facing an other that honorable discharge. i want to know if anyone has any advice on how he can fight this(if it is possible) as we are about to lose more than half our income every month and we need the money.

i am desperate for information because this is all happening so fast!!!!

You’re going to have to use terms normal people understand.

CO = ?
E-5 = ?
E-4 = ?

The military has their own courts. Him and his lawyer should be able to prove himself innocent.

Once he’s been judged against by the XO, not much recourse unless you think there was discrimination involved in the judgment. Check with a Military Lawyer regarding appeals processes, but honestly I think you are pretty much going to have to accept the decision and move on.

Time to get a civilian job.
