Is selling a song with a sample from a commercial/movie legal?

If you know anything about legalities please reply.

I recently made a track, but I’m unaware if I should sell it or give out a free download under creative commons right, seeing as it has 2 samples from a commercial in it, both less than 5 seconds long.

Any tips are welcome :D Thanks!

No it is not legal, someone else owns the rights to those commercials, you need to pay a feww top be able to have them on your track or remove them.

~LazyDaze~ is quite right, you have an alternative of getting permision from the owners/makers of the comercials.
Considdering you are playing such short clips, it is feasable you will get that permission. They might ask in return, that you put a link to there product etc on the website.

You don’t need permission as long as you don’t make them look bad, but you have to share the profit and royalties. Acknowledge them as co-authors.
