If you are pulled over and the cop flat out said in

front of everyone in the car that he was pulling you over just to check your car and you did nothing wrong, BUT you got a ticket because you were driving with only a learners past your curfue or whatever…

Would you fight it in ourt? Where i live a cop can not pull over a car for no reason unless he has reason to believe that a crime or traffic violation has been committed or will be committed. Now by this definition there would be NO way for the officer to be able to tell if my lincence was a learners or a full lincence from his car. Therefor making the stop arbitrary (the only way a car can be stopped like that (keep in mind this is where i live) Is if its a designated police check point (I was driving down the road and he drove up to a corner).

Anyways, I ended up getting a ticket (BTW I was less then a block away from my house, and my reasons for driving in the first place were to pick up a bunch of friends who were stuck at some drunk persons house and they didnt want to drive home with them). If i took this to court with the information I just provided you… Do you think i would have a chance at getting off this ticket? Im actually pretty good in court, I actually got off a noise ticket once. (the judge when i initially made my not guilty plea said that this should be interesting as he has never seen someone get off a noise ticket charge when it was obvious there was a party lol).

Anyways. 1. I had reason to believe that my friends would have been in danger if i did not break the law as they told me that they were going with this drunk guy even though they didnt feel comfortable. Therefore a normal person would be concerned about their friends life and help them out as human nature.
2. The stop was illegal as there was NO reason for to be conducted.
3. I could also say depending on what the officer in court has to say that he was basing his actions on my age (a car full of kids) and that this is discriminitory. (that would be my back up defence to make any false claims (I mean lets face it a cop can say anything) thrown out.

So… what do ya think? Keep in mind That i follow those curfue things with a lerners very carefully. Its that I honestly thought that I NEEDED to break it to help them out I would be devistated if they got in that car and crashed and they died or got hurt.

You say unless they have reason to believe….

You can try to fight it but its a waste of money because the cop didn’t do anything wrong

he had reason to believe you were doing something wrong, and you were.

Explain how he would have had a reason to believe I did anything wrong before he pulled me over?

Keep in mind as well my laws are most likely different then yours.

Dont base your comments on personal opinions. I wanted a reply from someone who is looking at this from a LEGAL perspective.

No its not. It falls under unreasonable search and seizure. as there was no reason for it. Ive looked up supreme court cases that this exact reason was given and the defendent won. Most of the time tho it regarded a house, BUT. This is why i wanted a legal perspective not an opinion.

Im not saying i only want lawyers or anything to reply. But i am looking for LEGAL discussions. Not vague statements that are based on PERSONAL opinion.

Also. There is provisions that state that if the law is being broken to protect human life, or where the law would infringe in ones ability to preserve life yada yada yada… basicially saying that laws are not more importiant then a life. (Except in cases where breaking the law would endanger more lifes) Blah blah blah. (I.E lots of loop holes)

Take one of your friends as a witness to what the officer said. “To check you out” is not a viable reason to pull someone over. You were not breaking any laws as far as he could tell.

Yea they said they will go to court with me. only problem is, school takes place during court hours, any suggestions to work around this? or would we basicially be stuck with missing school.

I skipped school to go to court when I was 16 the first time I ever got a traffic ticket. My parents never found out. I can’t really suggest that you do this…

Skipping school to go to court? Im a youth that lives on my own. I Take Online courses from the college. So… thats no issue lol XD. Im rather knowledgeable when it comes to law and english related topics, but if you ask me anything like we’ll take 15% off your ticket… im totally clueless. XD.

I have witnesses, and by the time my traffic ticket gets to court, it will be summer anyways, my initial court date is set for three months from now and then another estimated month before I actually get to go to court and argue it.

By then ill have the cash to pay it… (just in case lol) But I really dont think a ticket given by illegal means to make someone pay for doing something else illegal should be allowed lol. XD.
