I was in a car accident yesterday.
This had been a rough year, hence me not being on here as often, and just got 10x rougher when I got into a car accident yesterday. Me and the kids are fine, thank goodness, and our SUV took a lot of damage.
I was in the left turn lane with my blinker on making a left turn after the light had turned red. One car barely squeaked through as the light went from yellow to red, and I waited for him then proceeded forward. The empty lane between two other lanes of cars suddenly had a white GMC SUV come racing between the other two lanes and hit my vehicle on the front right side, spinning me around a full 180 degrees. I can still remember what it felt like when we got hit…It was a 15 year old girl with a permit driving with her dad. Young and way inexperienced, so she didn’t know how to react fast enough to hit the brakes I guess…so scary. Luckily, I had a very kind woman - the woman who was driving behind the girl who hit me - stop and give me her contact information, and she said she saw the lady speed through the red light and slam into me. I called my insurance after I got home yesterday and gave them her contact info. My insurance says everything should be taken care of through the other party’s insurance and I’ll get a rental until my car is fixed or I receive a check for the cost of the vehicle if it’s declared a loss.
When I talked to the police officer beforehand, however, she said it could also be my fault because I didn’t yield to oncoming traffic! Despite it being a red light! I don’t think I explained clearly to the officer that she wasn’t there when I started my turn and when I did see her speeding towards me I did hit my brakes - it’s a good thing I did! One of my twins was on the inside of the rear right side of my car…if she’d hit there…I can guess what would have happened, and it scares me. I’m lucky she just hit the front right of me. I was in my Ford Escape, by the way. Tough little thing. But now a broken little thing. Better it than one of us, though.
I guess my question is, my mom said I could also sue for pain and suffering once the insurance found in my favor, and I do have a witness. Has anyone had experience with something like this? I know if my car is a loss, I’ll never get what I paid for it due to depreciation. As far as injuries go, my poor daughter’s nose and upper lip were smashed when she hit one of her brother’s car seats, and I’ve got bruises on my left leg and what feels like a bad rug burn on my hand - I don’t know if it’s from the airbag deploying or what, but the USAA rep said the powdery substance could have irritated it. And as far as mental damage goes, if that even counts…I couldn’t sleep last night. I cried so much I had a migraine and threw up. Twice. I keep remembering the car hitting me, my daughter screaming, her bloody nose…no one should ever have to go through this crap! I have no vehicle. The accident happened 15 minutes after I dropped my husband off at the airport to go to California for military training, so I’m doing this on my own. That was our only vehicle.
Thank goodness for good people in the world though, so many people helped me get my kids out of the car and to the sidewalk and the paramedic from the fire truck and talked to me to get me to calm down. Even the tow truck guy was nice.
The father of the girl driving the vehicle that hit mine said “I’m so sorry” twice to me, and we exchanged information. I asked the girl if she was OK, and she nodded, but she was sobbing the entire time. That’s all that was said between us, and my kids and I went with my Mom in her vehicle afterwards.
Any advice is appreciated, thank you so much for reading. I feel a little better getting this all down.
