My younger brother ran our motorbike into the side of a truck a few days ago.

The truck made an illegal U-turn infront of him. He did’t have time to stop, or avoid the truck, so he (and his girlfriend, who was riding with him) slammed into the truck. There were no major injuries, but our bike is a write-off.
My question is, do you think my brother should sue?

Glad there’s no injuries, but without injury there may not be a case. Was the truck driver issued a ticket?

Be thankful no one was hurt. They should get checked out by a doctor just in case. If there is no injury, then the only case you would have would be for the personal property.

Well yeah, if we did sue, it’d be for the money for the bike, but you mean you can’t sue someone for endangering your life by driving illegally?

No, it would be considered a frivelous law suit. There was no damage to the people involved. Only the bike.

By what reason would they sue for that? Nobody endangers somebody else by intention. If the mistake was bad enough, he will have the police on his back.

But with no other injuries, the matter is of course about the bike, clothes and so on. Doesn’t the insurance cover that? Any costs beside the paid insurance return should of course be covered by the one who is judged as responsible for the accident.
