My husband has been sitting in jail since MArch 22, 2006 awaiting trial for a crime he did not commit.

He is going to trial in July of 2007. I just want him to come home. We have a daughter who is going to be 3. She doesn’t remember him before this. She only knows him through seeing him through a peice of glass once a week. I just want him to come home.

the witness that says it wasn’t him won’t go to court because he has a warrant. he has since dissapeared.

Yes, definitely get a lawyer. That is what they are here for—to assist you in situations like this. Is there any other exculpatory evidence? Rememeber that in our criminal justice system the accused has the presumption of innocence. The mere lack of defense witnesses is not enough to convict on. What evidence will the prosecution be presenting? You have a right to know these thngs before proceeding to trial, otherwise the conviction will be reversed on appeal for a due process violation. So tell us everything you think you can and perhaps we can help.

they say that a bb gun we had was used to beat one of the victims. well the crime lab said that this was not the gun that was used. there are 3 victims. a woman outside the ymca. her id was “he looks the most like guy who robbed me” the second guy a janitor at a middle school. he picked out a picture of my husband at the police station and said it was him. now when our private investigator shows him the same photos he is unable to pick my husband out. the third is the taxi driver who was beaten. the taxi driver told our private investigator that he thinks that they have the wrong guy. the prosecutions only evidence is the victims statements against him. and the bb gun that the state crime lab said was not used in this crime.

That doesn’t sound like mch of a case, to tell you the truth. Get yourself a good lawyer and you should be able to have him acquited no problem.

i am hoping that he will be able to be found not guilty and come home soon. his trial is july 24. he has a court date on july 10. they will try to offer him a deal on that date. i just want him to come home.
