They are mistaken. In the absence of insurance, you could get a judgment against him and he would be on the hook to pay.

The problem is, however, that there are thousands of irresponsible turkeys like this guy running around. Most of them have little or no assets. Lawyers have a term for them: judgment proof. You can sue, you can win, but you can forget about collecting.

Around 90 percent of court judgments do not produce a penny for the plaintiff.

I have dealt with things like this before, and I can tell you that if someone has no insurance and no assets, you are wasting your time trying to collect. What’s more, your OWN insurance company will subrogate against this turkey to reclaim medical costs . . . further guaranteeing he won’t have anything to give you.

My advice: forget about this bum, bite the bullet and get your daughter’s car fixed, and buy collision insurance with an uninsured motorist provision.

No, this guy shouldn’t be allowed to drive until he gets insurance, and if you can make that happen, you’ve done about all that is possible. Even with a suspended license, however, you can bet this turkey will continue to drive.

The good news: neither you nor your daughter were seriously injured. But it was also a wake-up call: increase the limit of your medical coverage!
