There is federal law that defines breaks but the law does not require employers to give breaks. Breaks are seen as a benefit the employer is giving to the employee (much like a vacation). A little less then half the states in the US have laws requiring employers to give breaks under the federal definition of breaks. Also, OSHA requires breaks be given to those working in highly hazardous conditions. Most employers that due give breaks have done their homework, studies have shown that workers who are given 15 minute breaks every 2 hours improve in productivity by 10-15%.

I even worked a 36 hour shift before because 2 people form morning tower never showed up so I had to fill in. You can take 5 when you use the bathroom. If you want the job you will do what it takes. Remember you can always be replaced. Hope this helps :-)
